§ 18.5-36. Appeal
Appeals from any decision of the planning commission and city council under this article shall be de novo to the city council in accordance with section 30-40 of the zoning ordinance of the City of Victoria. The planning commission may recommend and the city council may grant a variance from the requirements of this article only if the variance meets the following requirements:
(1) The requirements imposed by this article would result in extraordinary hardship; and
(2) The physical features and characteristics of the proposed plat or site plan are such that a waiver would not impair the intent and purpose of the requirement; and
(3) The variance will not endanger or present a threat to the public health, safety, or welfare; and
(4) Granting the variance would observe the spirit of this article and secure public safety and welfare.
