§ 18.5-52. Exemptions
(1) Section 18.5-51 of this article does not apply to:
(a) New development to be developed exclusively for nonresidential uses; or
(b) New development to be developed according to federal regulations restricting occupancy in the dwelling units to elderly persons.
(2) The City of Victoria may exempt a new development to be developed as a retirement community.
(3) The City of Victoria may exempt from the terms of this division the subdivision of an original tract of land for transfer to a member of the immediate family of the owner(s) of the original tract of land for the purpose of constructing a single-family dwelling. Any such subdivision shall contain a statement on the plat, signed by the owner, that:
(a) Certifies the intent of the owner to transfer the land only to a member of the immediate family; and
(b) Expressly warrants that no conveyance of the lot will be made to anyone not a member of the immediate family for a period of ten years, except as may be required to satisfy a mortgage in case of loan foreclosure.
