§ 30-114. Nonconforming uses

  • (a) The lawful use of land for junkyards and storage purposes which does not conform to the provisions of this chapter shall be discontinued after January 23, 1974, and the same uses of land which become nonconforming by reason of a subsequent change in this chapter shall be discontinued within five years from the date of the change.

    (b) Nonconforming uses shall file for a conditional use permit within one month of the date on which the use became nonconforming.

    (c) Signs existing as of January 23, 1969, which do not conform to the regulations set forth in this chapter shall become a nonconforming use and shall be discontinued within a reasonable period of amortization of the sign. Uses of signs which become nonconforming by reason of a subsequent change in this chapter shall also be discontinued within a reasonable period of amortization of the sign. The period of amortization for signs shall be not more than:

    (1) Advertising signs for five years from the effective date of the ordinance from which this article derives.

    (2) Business signs for ten years from the date of erection or five years from the effective date of the ordinance from which this article derives, whichever is greater.

    (d) Business signs on the premises of a nonconforming building or use may be continued, but such signs shall not be increased in number, area, height or illumination.

    (e) No sign erected before the passage of this chapter shall be rebuilt, altered or moved to a new location on the affected property without being brought into compliance with the requirements of this chapter.

    (f) Onsite sewage disposal systems which are substandard and improperly functioning shall be brought into conformance with the city septic tank ordinance.

    (g) In the floodplain area any addition or modification to a lawful nonconforming use shall be in conformance with the provisions of this chapter and shall not increase flood damage potential or increase the degree of obstruction to flood flows.
